As the elected representatives for Strathclyde University Ski and Snowboard club, in order to have a solid framework in which to provide the best service possible for our members, we establish a codified constitution, April 2008. Ratified for 09/10.
Article 1 – Elections
Section 1
Final legislative power lies in the executive committee (exec).
Section 2:
The exec shall be elected during the second semester.
Section 3:
The exec reserves the power of veto at the elections. This power shall only be enacted in the case of a unanimous decision by the existing exec as to the inadequacy of a candidate elected to a position for the new year on that night. In this case the exec has the power of appointment of a candidate to a position on the committee.
Section 4:
The exec shall conduct the voting using a confidential ballet.
Section 5:
The exec shall count and recount the votes taken at the elections. The counting will be done in the presence of the candidates or parties representing the candidates so as to make the results incontestable and fair.
Section 6:
If at any time one of the committee is found or decides themselves to be unfit or incapable of fulfilling the role designated to them during the elect year, the matter shall be decided upon by the exec – either to appoint another representative to that role, or to spread duties amongst the remaining members of the committee. The exec will require a two thirds majority to carry out any action.
Section 7:
i. Candidates for election should register 24 hours before the AGM
ii. Unannounced candidates can run for any unchallenged position on the night, however, they may NOT run for a challenged position
iii. If an announced candidate does not win the election for the their position then they may run for one other subsequent position on the night
Section 8:
In the event of a draw at the election – two or more candidates for a position receiving the same number of votes – it will become the new exec’s responsibility to vote on who would be most suitable. This vote should be conducted using committee voting procedures as outlined in “Article 2” below.
Section 9:
Where one or more people stand for a position, the motions open to the voter will be VOTE FOR or ABSTAIN. The former exec may use the results to decide whether or not they should use their power of veto for any given candidate.
Section 10:
People voting in elections must prove they have been active members of the club in the last year by either holding a valid membership card or by having taken part in a BUSC event, SUSC Holiday, Race Training or Lessons.
Article 2 – The Exec
Section 1
Final executive power shall be vested in the President of the Strathclyde University Snowsports Club (SUSC); terms on the executive shall last one year – from one election to the next. The date of the election is to be decided by the president.
Decisions taken by the exec. should be done on the basis on one vote each. Each member of the exec. may vote FOR, AGAINST or ABSTAIN from voting. The decision shall be settled by majority. In the event of a tie, the President shall have the casting vote.
The President should have primary power over the Strathclyde University Winter Tour. This includes duties of price and free place negotiation, passenger management, operator management, Health and Safety and any duties necessary to be undertaken whilst on the holiday itself. As this event is one of the most significant and complex in SUSC’s calendar it is advised that many of the organizational aspects of the holiday should be undertaken in a degree of collaboration with the previous year’s President.
Added to this he/she will be in charge of promotion, placing and passengers for BUSC’s “Main Event” or any alternative Easter Tour.
The president should, if possible have spent at least one year serving on the Exec of the Ski and Snowboard Club. This amendment could significantly and unfairly influence the 2008/2009 election so will be delayed for two years and will only come into affect for the 2010/2011 committee elections.
The president’s duties shall first and foremost be the management of the exec and the club. Aside from this duty, he/she will also be responsible for club correspondence, dealings with the Strathclyde University Sports Union (SUSU), helping to find and encourage sponsors and sponsorship, organising the holidays and overseeing all facets of the club.
In event of the president temporarily not being able to fulfil his/her duties the vice-president shall take the responsibility. The order of responsibility after that: Treasurer, Social Secretary, Ski Race team Captain, Snowboard team Captain.
The Vice-President shall share in these roles to a degree that is agreed upon by the president and vice-president.
Any long-lasting decision taken by the president and/or vice-president MUST first be unanimously agreed upon by the rest of the Exec. It may also be decided upon that a member’s vote/referendum may be best for deciding some issues – particularly those affecting the club as a whole.
All communication between the committee and staff at the University MUST AT ALL TIMES be conducted using the Sports Union as an intermediary.
Section 2:
The Treasurer shall be responsible for the accounts of SUSC. Any sums of money over £50 being paid out of the accounts must be ratified by the president before their processing. A close working association with all other committee will be essential to monitor spending.
Section 3:
The Sponsorship and Fundraising director with have primary responsibility over the management and attraction of sponsorship for the club.
Section 4:
The Social Secretary should have primary power over organising and running socials and social events, both at home and abroad.
Section 5:
The Race Team Captains will have complete responsibility for entering their teams into Greave’s Leagues and BUSC organized events and races. In order to do this they should have a working relationship with the treasurer. Another complete responsibility includes the selection of race teams. As such they should have a deputy within their team, thus in the event of them not being able to attend a competitive event another will be able to perform their duties. They should encourage the year round participation of students in the teams socially and sportingly.
They will also be responsible for the promotion of freestyle competitions, and encourage individuals to train and compete for these events.
Section 6:
The Vice President/secretary is responsible for the administration of the club – monitoring and updating membership lists, producing minutes for club meetings and helping with the day-to-day running of the club wherever possible.
Article 3 – General
Section 1
The club account may under NO circumstance be used for any purposes other than SUSC business.
Section 2:
The exec. will to the best of its ability provide opportunities to learn to ski/board, compete, go on holiday, socialise, and purchase specially designed club merchandise.
Section 3:
With any area of the club’s operations such as sponsorship, socials, etc. the exec are obliged to help wherever possible and wherever they may provide advantage for the club and its members.
Section 4:
The club should have a Jordan Hill representative so that during the fresher’s fair and throughout the year the Jordan Hill campus is as involved as the rest of the University with SUSC news and events. It is up to the exec. how and if the rep is rewarded for this.
Section 5:
Amendments may be made to this constitution if they are unanimously agreed upon by the exec-elect, or in the case of issues concerning/affecting the whole club a referendum may be used to decide the outcome of the proposed alteration.
Section 6:
Where possible, the exec should hold events outwith term time. If however, it is unfeasible to accommodate events such as the holidays outwith term time, it MUST be made patently clear when advertising the event, that the exec, Sports Union nor University condone missing academic commitments to attend the event. If however, the event involves competing for the University, special dispensation may be sought through the Sports Union.
Article 4 – Ratification of Constitution
Section 1
Any changes to the constitution to be made at the AGM or EGM must be announced 24 hours prior to the meeting and any ratified changes that would effect subsequent matters at the current meeting, will not come into action until the meeting ends.
Amendments can be made at AGM’s, EGM’s, or by unanimous exec vote.
